Terms and Conditions of Use of Contents Pilot

These Terms and Conditions describe how Contents Pilot operates, what you can expect from the platform, and the responsibilities you accept when creating or distributing AI-generated content. Please read each section carefully.
To facilitate the understanding of these Terms, the terms below, when used with the first letter capitalized, will have the following meanings:
• Platform: Refers to the online Contents Pilot platform, accessible via the internet, which offers Artificial Intelligence solutions for content creation.
• Services: The features and resources provided by the Platform, including, but not limited to, generation of texts, images, posts, carousels, infographics, and other content formats for social media.
• User: Any individual or legal entity that accesses or uses the Platform, whether for registration, plan subscription, or use of free features.
• Generated Content: Any and all text, image, art, infographic, post, carousel, or other material created, processed, or exported by the User through the Platform, using Artificial Intelligence tools.
• Artificial Intelligence (AI): Refers to the technology used by Contents Pilot to automate and assist in content creation, generating humanized texts and images.
• Personal Data: Any information relating to an identified or identifiable natural person, as defined by the GDPR.
• Data Controller: Contents Pilot, responsible for determining the purposes and means of processing personal data.
• Data Protection Officer (DPO): Person designated by Contents Pilot to act as the point of contact for data subjects and supervisory authorities.
• Privacy Policy: Separate document that details how Contents Pilot collects, uses, stores, protects, and shares Users' personal data, in compliance with the General Data Protection Regulation (GDPR).
• Cookie Policy: Separate document that explains the use of cookies and similar technologies on the Platform.
Contents Pilot offers an innovative platform that uses Artificial Intelligence to assist Users in creating content for social media. Our Services aim to optimize the content production process, providing tools to generate humanized texts and images, with the goal of engaging the User's audience.
3.1. To access and use most of the Platform's Services, it is necessary for the User to register, providing complete, accurate, and truthful information. The User commits to keeping their registration data always updated.
3.2. The User is responsible for the confidentiality of their access credentials (login and password) and for all activities performed in their account. It is essential that the User does not share their login and password with third parties. Contents Pilot is not responsible for any damages resulting from improper use of access credentials by third parties.
3.3. In case of suspected unauthorized use of their account or any security failure, the User must immediately notify Contents Pilot through the contact channels indicated in these Terms.
4.1. Contents Pilot offers different subscription plans, with specific features and usage limits, as detailed on our website. Plans are automatically renewed, unless the User cancels according to the instructions provided on the Platform.
4.2. Some Platform features may be paid. The User agrees to pay all applicable fees as described on the website and in the contracted plan. Non-payment of fees may result in suspension or termination of access to paid features or the Platform as a whole.
4.3. Contents Pilot reserves the right to change plan prices and features at any time, with at least 30 days prior notice to Users. Such changes will not affect already contracted plans during their validity period.
5.1. In accordance with the EU Consumer Rights Directive (2011/83/EU), the User has the right to withdraw from the contract within 14 (fourteen) calendar days from the date of purchase of any paid plan, without giving any reason. To exercise this right, the User must inform Contents Pilot of their decision through the contact channels.
5.2. Contents Pilot will reimburse all payments received from the User without undue delay, and in any event no later than 14 days from the day on which Contents Pilot is informed of the User's withdrawal decision.
5.3. After the 14 (fourteen) day withdrawal period, no refunds will be made for partial usage periods or for already used plans. Cancellation of subscription plans can be made at any time by the User, but will not entitle them to proportional refund, except in cases provided by applicable law.
5.4. Cancellation does not affect the User's rights regarding their personal data, which may be exercised as described in the Privacy Policy.
6.1. The amount of Generated Content is limited according to the subscription plan chosen by the User. Contents Pilot does not guarantee a specific number of characters, words, or images per generated content, as the nature of AI creation may vary.
6.2. Server restrictions, high demand, scheduled maintenance, or force majeure events may temporarily limit the availability or speed of content generation. Contents Pilot will make reasonable efforts to minimize such interruptions.
6.3. Nature of AI-Generated Content: The Content Generated by Contents Pilot's Artificial Intelligence is a support and automation tool. Although the Platform is designed to generate humanized texts and relevant images, the Generated Content SHOULD NOT BE CONSIDERED INFALLIBLE OR FREE FROM ERRORS, OMISSIONS, OR INACCURACIES.
6.4. User Responsibility for Generated Content: The User is responsible for reviewing and validating all Content Generated through the Platform before publication, including its truthfulness, legality, adequacy, originality, and compliance with third-party rights (copyrights, intellectual property, image rights, privacy, etc.). This responsibility does not exempt Contents Pilot from its obligations under applicable EU consumer protection laws regarding service defects.
6.5. Verification and Adaptation: It is the User's responsibility to review, verify accuracy, adapt, and validate all Generated Content before its publication, disclosure, or any other use.
6.6. AI Data Processing: Contents Pilot uses third-party artificial intelligence providers (including OpenAI) to generate content. Data provided by the User for content generation is processed by these providers exclusively for the purpose of delivering the requested service. For users in the EU, such processing involves international data transfers as described in our Privacy Policy. Where the User provides personal data of third parties as input, the User is responsible for ensuring a lawful basis for such processing. 6.7. Contents Pilot does not claim ownership of the Content Generated by the User and will not use it for commercial purposes without the User's express consent, subject to the terms of the Privacy Policy.
The User commits to using the Platform in an ethical, legal manner and in compliance with these Terms, current legislation, and good faith principles. It is strictly prohibited:
a) To use the Platform to disseminate, create, or promote illegal, defamatory, slanderous, obscene, discriminatory, hateful, threatening, harassing content, or that incites violence or criminal activities.
b) To infringe third-party rights, including, but not limited to, copyrights, trademarks, patents, trade secrets, image rights, privacy, and intellectual property.
c) To perform reverse engineering, decompile, disassemble, modify, or attempt to discover the Platform's source code.
d) To use bots, spiders, crawlers, or any other automated means to access, collect data, or interact with the Platform in an unauthorized manner.
e) To attempt to obtain unauthorized access to systems, networks, or accounts of other Platform Users.
f) To interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
g) To use the Platform for spam, phishing, or any other fraudulent or deceptive activity.
h) To publish or transmit any material containing software viruses or other codes, files, or computer programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
i) To perform any activity that may overload, damage, or harm the Platform's infrastructure.
Non-compliance with these restrictions may result in immediate suspension or termination of the User's access to the Platform, without prejudice to applicable legal measures.
8.1. All intellectual property rights related to the Contents Pilot Platform — including, but not limited to, source code, features, visual identity, brand, logo, institutional texts, plugins, AI algorithms, training models, and other technical or design elements — belong exclusively to Contents Pilot or its licensors, being protected by international intellectual property legislation.
8.2. Simple access or use of the Platform does not grant the User any ownership or license rights over these assets, except in cases expressly provided for in these Terms of Use or in a specific contract. Any unauthorized use of Contents Pilot's intellectual property assets is strictly prohibited.
8.3. User Content: All Content Generated by the User through regular use of the Platform — such as texts, arts, AI-generated materials, and other creations inserted or exported — is their exclusive property, respecting the rights of third parties eventually involved. Contents Pilot does not claim ownership of this User Content and will not use it for commercial purposes without the User's express consent, except as necessary to operate and improve the Services, or as provided in the Privacy Policy.
8.4. The User grants Contents Pilot a limited, non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the User Content only to the extent necessary to operate, provide, improve, and develop the Platform's Services. For research and development of AI technologies, content will be used exclusively in an anonymized or aggregated manner, making it impossible to identify the User, in compliance with the Privacy Policy and the GDPR.
8.5. The User commits not to use the Platform to create, share, or distribute any content that violates copyrights, trademarks, trade secrets, or other third-party intellectual property rights.
8.6. In case of suspected copyright, trademark, or other intellectual property rights violations — whether by the Platform or third parties — the holder may file a complaint through Contents Pilot's official channels. Every complaint will be treated seriously, and appropriate measures may be adopted, such as content removal or access suspension, in accordance with applicable legislation.
9.1. The Platform and Services are provided "as is" and "as available", without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free availability.
9.2. Contents Pilot does not guarantee that the Platform will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Platform or the server that makes it available are free of viruses or other harmful components.
9.3. The limitations of liability in this section do not apply where applicable EU consumer protection laws, including the Unfair Contract Terms Directive (93/13/EEC), do not permit such limitation. In all other cases, Contents Pilot shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Platform.
9.4. In the event of a personal data breach, Contents Pilot will take the measures required by Articles 33 and 34 of the GDPR, notifying the supervisory authority within 72 hours and informing affected data subjects without undue delay where the breach is likely to result in a high risk to their rights and freedoms.
The Platform may contain links to third-party websites or services that are not owned or controlled by Contents Pilot. Contents Pilot has no control and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. The User acknowledges and agrees that Contents Pilot shall not be responsible, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such websites or services.
11.1. Contents Pilot may suspend or terminate the User's access to the Platform with 30 days prior notice, for any reason. In case of serious violation of these Terms, fraudulent activities, or non-payment of applicable fees, suspension may be immediate.
11.2. Upon termination, the User's right to use the Platform will cease immediately. If the User wishes to terminate their account, they may simply discontinue using the Platform or follow the cancellation instructions available on the Platform.
11.3. After termination, the User will have 30 days to request portability or deletion of their personal data, as provided in the Privacy Policy and the GDPR.
11.4. The provisions of these Terms that, by their nature, should survive termination, will survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
12.1. These Terms will be governed by and construed in accordance with the laws of the Federative Republic of Brazil. For Users residing in the European Union, nothing in these Terms shall affect the mandatory consumer protection provisions of the law of the EU Member State in which the User is habitually resident, including the rights granted under the GDPR.
12.2. Any disputes arising from these Terms shall preferably be resolved through direct negotiation between the parties. If negotiation is insufficient, the parties may resort to mediation or arbitration mechanisms.
12.3. For EU consumers, disputes may also be resolved through the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
12.4. Nothing in this section restricts the User's right to bring proceedings before the courts of their habitual residence, in accordance with applicable EU consumer protection law.
Contents Pilot reserves the right to revise and update these Terms periodically, at its sole discretion. The most recent version of the Terms will always be published on the Platform, with a clear indication of the date of the last update. Substantial changes will be communicated to Users at least 30 days in advance via email or notification on the Platform. Continued use of the Platform after the notification period constitutes acceptance of the changes.
14.1. Complete Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the complete agreement between the User and Contents Pilot regarding the use of the Platform.
14.2. Independence of Clauses: If any provision of these Terms is considered invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
14.3. Tolerance: Contents Pilot's failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
14.4. Assignment: The User may not assign or transfer these Terms, or any rights or obligations contained herein, without Contents Pilot's prior written consent. Contents Pilot may assign or transfer these Terms, at its sole discretion, without restriction, provided that the User's rights, including those related to data protection, are maintained.
